Terms and Conditions Personalised Diet Plans
It is the aim of the Nutritional Advisor – Lucy Provenzano, trading as Pole Fit & Flexy, to provide a professional and courteous service to clients. In doing so, the following should be noted.
In order to provide the best service possible, a number of measurements will need to be taken which may include weight, height, body fat pinch tests, body size measurements as well as ‘before’ and ‘after’ pictures. If the client does not agree to these tests then the nutritional advice given will be less accurate and will make it difficult to track client progress. It is strongly advised that the client agrees to these initial tests and measurements in order to receive an optimum tailored advice.
The diet plans made and given to clients are a guideline only and are formed based on the information provided in the initial consultation. Each diet plan varies and may not be suitable for everyone. Clients are advised to report any concerns about their diet plan promptly to the Nutritional Advisor for discussion and action.
Nutrition and dietary advice is not a substitute for professional medical advice and/or treatment and clients are responsible for contacting their GP about any health concerns.
Nutritional advice will be tailored to support medically established, diagnosed conditions and/or health concerns identified and agreed between the Nutritional Advisor and client. Nutritional Advisors are not permitted to diagnose, or claim to treat medical conditions. It is the responsibility of the client to provide the Nutritional Advisor of such conditions in the initial consultation or as soon as they arise. It is always best practice for the client to consult their GP before beginning any new diet or exercise programme, it is the client’s responsibility to do this should they feel it necessary to.
The client must inform the Nutritional Advisor of any medical diagnosis, medication, herbal medicine or food supplements they are taking as this may affect the nutritional programme.
If the client is receiving treatment from their GP, other medical provider or complementary therapist they should advise them of any nutritional strategy provided by the Nutritional Advisor. This is necessary in case of any possible reaction between medication and the nutritional programme.
The Nutritional Advisor can only advise what is appropriate when it comes to exercise plans, for a more structured exercise plan the client should seek advice and support from a REPs accredited personal trainer.
Whilst every effort will be made to provide a diet plan to help the client achieve their goals, it must be understood that not all diet plans are successful. It is the client’s responsibility to follow the diet plan as directed by the Nutritional Advisor in order to achieve the best results.
The client agrees to stop the programme undertakings immediately and inform the Nutritional advisor of any symptoms if, at any time, they begin to feel excessive pain or discomfort. It is the client’s responsibility to report any symptoms to their GP.
The client should contact the Nutritional Advisor for clarification if unclear about any areas of the agreed nutritional programme including supplementation and timeframes. If clients wish to continue a dietary supplement or programme longer than the specified period a check-up will be strongly recommended by the nutritional advisor to re-assess the suitability of the programme at an additional cost of £10.
The diet plans will be released to clients within 14 days of receipt of their completed food diaries. If this time frame is not adhered to by the Nutritional Advisor, the client will be eligible for a refund of 50% of their initial payment.
Nutritional advice can only be made to those aged 18 or above unless with parental consent. For these purposes proof of age may be required.
Upon purchase of a diet plan the client agrees to hold the Nutritional Advisor, Lucy Provenzano of Pole Fit and Flexy, harmless for claims or damages in connection with their work together under the terms of this form and the client understands that this consent form is a release of the liability of the Nutritional Advisor.
Payment must be completed in advance of the initial consultation.Payment includes the initial consultation, formation of diet plan and a follow-up consultation after 6-8 weeks only. Extra services will be charged as appropriate and only given upon receipt of further payment. During the period of the diet plan the client is able to contact the Nutritional Advisor for guidance and support as often as they feel necessary, at no further charge.
Pole Fit and Flexy requests that the client give 48 hours’ notice of cancellation for consultations. Less than 24 hours’ notice of cancellation of an appointment will incur a 100% cancellation fee.
The client is entitled to withdraw from the programme at any time without explanation; in such a case the client is not entitled to any refund. Although unlikely, the services may also be terminated at the discretion of the Nutritional Advisor with sufficient notice of 4 weeks, if the client has had their diet plan they are no longer entitled to a refund should this situation arise.
Information provided by the client for the purpose of the nutrition consultation will be stored for this purpose only and for legal requirements. Medical records and all notes made during the consultation sessions will be kept for records but will be stored in a secure location and kept strictly confidential. Data will not be passed to any third party. If a situation should arise where it is felt that a doctor should be informed it will be discussed with the client and the client’s permission will be sought before revealing any information to their GP.
The email address and telephone number provided will be used to keep in contact with the client and the client’s email address added to the mailing list to receive emails of new fitness blog posts, recipes and more. If the client DOES NOT wish their email to be put onto the Pole Fit and Flexy mailing list they can email us at firstname.lastname@example.org or opt out at a later date.
The client may be approached at a later date to ask if they would like their progress to feature on the Pole Fit and Flexy website, the client reserves every right to say no to this without giving an explanation.
The client understands that the intellectual property rights and privacy of all the materials and information provided to me during this programme. The client agrees to use the session handouts for personal, non-commercial purposes only and must not share them with anyone else.
By continuing to purchase this diet plan the client accepts these terms and conditions. The client will have to sign these terms and conditions on the day of the initial consultation.
If the client does not agree to these terms and conditions at the consultation, the consultation will not go ahead and the client will be allowed to reclaim only 50% of their initial payment.
